1. Introduction and Purpose
This Minimum Advertised Price (MAP) Policy is established by Eco-Novelty Corp, DBA Moist SAP ("Moist SAP"), to protect the integrity and value of our brands. This policy ensures fair competition among authorized resellers and maintains the premium perception of Moist SAP products.
2. Scope of Policy
This policy applies to all authorized resellers of Moist SAP products within the United States. It applies to all "Advertised Prices," which includes any price information publicly visible on websites, social media, print media, or search engines.
3. Prohibited Advertising Practices
To maintain the brand's premium standing, the following practices are considered violations:
- Public Display: Advertising a price below the MAP on any public-facing platform or search result
- Price Reveal Loopholes: Using phrases such as "Add to Cart to see price," "Click for price," or "Price shown in cart." The "Add to Cart" loophole is strictly prohibited.
- Automated Discounts: Site-wide coupons or "buy-one-get-one" offers that result in an advertised per-unit price below MAP.
4. Minimum Advertised Price (MAP)
The MAP for each product is designated in the official Moist SAP Wholesale Catalog. Moist SAP reserves the right to update these prices at any time with written notice.
5. Exclusions: "Selling Price" vs. "Advertised Price"
Moist SAP recognizes the reseller’s right to determine its own resale prices. This policy only applies to advertised prices. The following are not violations:
- In-Store Negotiations: A customer walking into a physical brick-and-mortar location and negotiating a lower price with the reseller.
- Private One-on-One Communication: Direct quotes provided to a specific customer via telephone, private email, or individual chat (provided these prices are not broadcast to the public).
- Checkout Completion: The final price paid by the customer at the end of a transaction, provided no sub-MAP price was advertised to attract the customer.
6. Policy Changes
Moist SAP reserves the right to modify, suspend, or discontinue this MAP Policy, in whole or in part, or designate new MAP products or change designated MAPs, at any time. All such changes will be communicated to authorized resellers in writing via email or the official wholesale portal.
7. Enforcement and Consequences
Moist SAP will unilaterally monitor compliance. Violations will result in:
- First Violation: Formal written warning.
- Second Violation: 30-day suspension of shipping and ordering privileges.
- Third Violation: Permanent termination of authorized reseller status.
8. Unilateral Policy
This is a unilateral policy. Moist SAP does not ask for, nor will it accept, any agreement or "assurance of compliance" from a reseller. Moist SAP will not discuss the terms of this policy with resellers; compliance is a condition of the continued right to purchase and sell Moist SAP products.
